Photography Agreement

Before we move forward with your photoshoot, please take a moment to review the agreement below. This outlines everything you need to know — from what’s included, to your rights, and what to expect before and after your shoot. Once you’ve read through the terms, simply complete the form at the bottom of the page to confirm your agreement.
This helps us stay on the same page and ensures a smooth experience.

1. Scope of Work

Photographer agrees to provide brand/portrait photography services as outlined in the agreed proposal. This includes:

  • Pre-shoot planning

  • Photography session at the agreed location

  • Final edited images (quantity quoted in original proposal)

  • Commercial use license for web and social media (unless previously quoted NO to social media via questionnaire)

  • Delivery via an online gallery within 3 weeks

2. Timing

  • Your shoot date and time will be confirmed via email upon booking.

  • At the Photographer’s discretion, a small selection of sneak peek images may be shared via email or social media.

  • Gallery will be delivered within 3 weeks of the shoot.

3. Post Production

Final images will be edited for colour, lighting, and overall style. Retouching (such as skin or background manipulation) is not included unless agreed in writing.

4. Fees & Payment

  • Total fee will be provided in your quote

  • A $200 non-refundable deposit is required to secure your booking

  • Remaining balance is due 3 days prior to the scheduled shoot

Payment Terms

  • To secure your session, a non-refundable deposit of $200 AUD is required within 48 hours of signing this agreement. Alternatively, you’re welcome to pay the full session fee upfront if preferred.

    Your booking will be confirmed once payment has cleared. If payment is not received within this timeframe, your session date may be released.

    The remaining balance (if applicable) is due no later than the day of your session.

5. Your Responsibilities

You agree to:

  • Arrive on time, prepared, and with agreed items or props

  • Ensure shoot locations are accessible and approved

  • Communicate any special requests that will require additional costs prior to session

  • If you arrive late to the session, the shoot will still end at the scheduled time. Additional time may be accommodated at the Photographer’s discretion and may incur an additional fee.

6. Cancellations & Changes

  • The deposit is non-refundable for cancellations made within 2 weeks of the scheduled shoot.

  • Reschedule requests must be made at least 48 hours in advance.

  • If the Photographer cancels, a full refund will be issued, or the session will be rescheduled at no extra cost.

  • If you need to change your shoot date, notify as soon as possible. While the deposit remains non-refundable, it can be transferred to a new session booked within one year.

Weather and Health Considerations

  • Outdoor shoots proceed in all weather conditions except rain. If it’s too wet on the day, the Photographer and client will decide whether to reschedule, move to a sunrise session, or relocate indoors.

  • If you or your children are unwell, please let me know. I’m happy to reschedule to protect everyone’s health — and I’ll never attend a shoot sick, especially around newborns.

7. Digital Files

  • You will receive high-resolution JPEG images only

  • RAW files are not provided

  • Final images will be available for download for 12 weeks. After this period, the Photographer is not obligated to retain the files. Clients are encouraged to download and back up their images promptly.

8. Ownership & Usage

  • Photographer retains copyright to all images

  • Client receives a commercial license for use on web, social, and marketing

  • Photographer may use images for portfolio, marketing or social media unless otherwise advised NO to social media via the booking form

9. Factors Outside Control

Photographer is not liable for poor weather, technical failure, late arrivals, or unforeseen events affecting the session.

10. Privacy

Your personal details and content of this agreement will remain confidential. Image use for promotion will never include personal or sensitive information.

11. Subcontractors

The Photographer may engage assistants or third parties to help complete services as needed, under the same quality and privacy obligations.

12. Complaints

Any concerns must be raised in writing within 7 days of receiving the final gallery. The Photographer will make reasonable efforts to resolve any issues.

13. Liability

The Photographer takes all reasonable care during the session, but accepts no responsibility for injury, loss, damage, or claims incurred by the Client or any third parties during the photoshoot. By proceeding with the session, the Client agrees that they participate at their own risk.

The Client is responsible for supervising all children and participants throughout the session and for ensuring the chosen location is safe and suitable.

The Photographer’s total liability, under any circumstance, is limited to the amount paid for the services under this agreement. No liability is accepted for indirect, incidental, or consequential damages.

14. Other Terms

This agreement is governed by the laws of New South Wales. No changes will be valid unless agreed in writing by both parties.

15. Special Terms

Any additional requests or client-specific terms that would require additional costs will need to be confirmed in writing via email before your session.
